People covered by Blue Cross plans between February 2008 and October 2020 could be eligible for part of a historic $2.7 billion settlement approved in Alabama last year as part of a long-running antitrust case.
Attorneys could receive about $700 million from the settlement, which leaves about $1.9 billion for people covered by Blue Cross Blue Shield plans during that time. Subscribers have until November 5, 2021 to make a claim online or by mail. Some of those eligible to file a claim may have received postcards notifying them of filing deadlines.
Claims can be filed online at the Blue Cross settlement website, which also offers additional information about who qualifies.
U.S. District Judge David Proctor in Birmingham approved the settlement late last year. It’s one of the largest health care settlements in U.S. history. In addition to the monetary amount, the agreement could change the way Blue Cross plans operate in the future.
Plaintiffs in the case claimed that Blue Cross plans divvied up territories to reduce competition in violation of antitrust laws. The lack of competition allowed some plans to charge higher rates for insurance coverage. Blue Cross plans involved in the case deny all allegations of wrongdoing.
Members of the class covered in the lawsuit have four options. They can file a claim as part of the settlement, opt out of the settlement and maintain the ability to file a separate lawsuit, object to the settlement in a letter to the court or do nothing and receive no payment. Those who wish to object must postmark their letters by July 28, 2021.
Proctor will hold a fairness hearing on October 20, 2021 where some affected members will be allowed to speak. The settlement could be finalized later this year.
